Terms of use

Please read these Terms of Use (“Terms”) carefully before using this portal operated by Toyota Insurance Management SE (“TIM”, “we”, “us”, or “our”).

 

Usage of the portal requires the user to accept these Terms prior to first login. If you do not agree to these Terms, you may not access or use the Services.

 

We reserve the right to suspend or terminate accounts that are used in violation of these Terms or applicable laws.

Modifications of the Terms will be communicated to you as a User either via the portal or email, and we might ask for your acceptance of these new Terms.

 

Definitions:

  • “Services”: Includes all content, features, functionality, and other services provided via the portal.
  • “Materials”: Any information, content, layout, design, text, images, graphics, software, and media on the Services.
  • “User” or “you”: Any individual that accesses or uses the Services.

 

Portal Services:

 

This portal is created as a surface for the Toyota Insurance Protect Anti Theft device. You can, depending on your role:

  • Order hardware, such orders being sent towards AvMap S.R.L., Viale Zaccagna 6, 54033 Carrara (MS), Italia (“AVMAP”)
  • Track hardware orders and installations
  • Check theft alerts or other alerts accessible in the tool and further process them
  • Register, maintain and delete users

 

Registration and usage

 

The User receives access to the portal via an administrator. For the registration, email-address, name and password are necessary.

Each access is personal, non-transferable and may only be used by the registered user within the scope of his or her assigned role.

Users have role-based access rights. The User is not allowed to pass on the password to third parties in order to circumvent the role-and access based restrictions.

If you suspect that another individual knows your login data or that your account has been used by someone else, you must inform your administrator immediately of this suspicion so that we can initiate the appropriate security precautions, such as blocking your account.

 

Confidentiality obligations

Please note:

 

Unauthorized disclosure of such information can impair the effectiveness of the Anti Theft device and lead to damage for customers, insurer, dealer or other parties involved.

 

Any disclosure of your user access, information about the installation of the underlying hardware, or any other disclosure of information obtained via this portal can, in the worst case, lead to monetary damage for the customer and the insurer.

 

You are therefore obliged to the following:

 

You need to keep the information provided confidential – in particular this applies for information around the installation of the hardware, as well as your access data to the portal. You do not make this information accessible to any third party – also not to other users with other or lower access rights!

 

You agree to use the Services only for lawful purposes.

 

You agree not to take any action that would compromise the security of the Services, makes it impossible for others to properly access the Services, or otherwise harms the Services or the Materials.

Disclosure of the information obtained is only permissible if it is necessary for proper use within the scope of the assigned role or if there are mandatory legal obligations.

This obligation shall continue to apply even after termination or blocking of portal access.

 

Liability for the Services

The information provided in the portal is intended to support the portal’s processes. Statutory liability claims shall remain unaffected in accordance with the liability provision below.

 

TIM takes appropriate technical and organizational measures to secure the portal. However, it cannot be guaranteed that data transmission will be available at all times without disruption or errors, or that it will be absolutely secure.

 

Liability claims against us or our affiliates, suppliers and/or subcontractors relating to material or immaterial damage caused by the use or non-use of the information provided or by the use of incorrect and incomplete information are generally excluded, unless they are based on an intentional or grossly negligent breach of duty on our part. This does not apply to damages caused by negligent breach of essential obligations, the fulfilment of which is essential for the proper execution of the contract in the first place and on the compliance with which the contractual partner may regularly rely. Liability in the event of a breach of essential contractual obligations is limited to the regularly foreseeable damage. These limitations of liability do not apply in the event of injury to life, limb or health. Likewise, our liability arising from the assumption of a warranty, due to a fraudulently concealed defect or under mandatory statutory product liability provisions is not limited.

Applicable law and severability clause

 

These Terms of Use and any disputes related to these Terms of Use are governed by German law, without regard to the principles of UN-sales laws. Mandatory legal provisions of the country in which the user has his or her registered office/main residence remain unaffected insofar as they are mandatorily applicable.

 

Should any provision in these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provisions. The validity of the remaining provisions remains unaffected

The same applies if these usage terms prove to be incomplete.
